Bloomberg reported on July 26 that roughly $1.4 billion in gains earned by Donald Trump and associates from meme coins and other tokens has become the central flashpoint threatening passage of the CLARITY Act.
Democrats are pressing to tighten guardrails aimed at preventing a president from continuing to profit from a cryptocurrency industry he helps regulate. Trump would need backing from at least seven Democratic senators to move the bill forward.
A major Democratic objection targets enforcement: the party opposes making the Department of Justice—led by a Trump-appointed attorney general—the primary enforcer of ethics rules, and wants state attorneys general granted independent authority.
Senators Ruben Gallego and Thom Tillis are in talks on a compromise. Senate Majority Leader John Thune has suggested the measure may not clear the chamber before the August recess.
Critics say the current draft would allow Trump to sell a large stake in his crypto venture or place it in a blind trust, but stops short of requiring a sale. The ethics language applies only to officials with a "direct interest" in crypto assets, leaving uncertainty over whether it covers Trump's roughly 38% indirect stake in World Liberty Financial through DT Marks DEFI LLC. The bill also sets no limits on officials' children, and the ethics provisions would sunset on January 20, 2029.
Beyond conflicts-of-interest, Democrats are seeking stronger consumer protections and tougher measures against illicit finance. The banking industry is lobbying for tighter limits on stablecoin incentives.
The odds of the CLARITY Act passing this year have slipped to about 33%, roughly half the level seen after the Senate Banking Committee backed an earlier version in May.
