The legislation would create a federal regulatory framework for crypto companies by splitting oversight between the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC). On July 29, Republican Sen. Thom Tillis and Democratic Sen. Ruben Gallego delivered to the White House a proposal that would allow state attorneys general to enforce a ban on federal officials issuing or sponsoring digital tokens. Under the proposal, enforcement would not rest solely with the Department of Justice. The House approved this version on July 17 by 294 to 134, with more than 70 Democrats voting in favor. The Senate has yet to hold a full vote. Passage will require 60 votes, meaning that even if Republicans unite behind the bill, at least seven Democratic votes would still be needed.
